457 Visa Update as at March 2009

Priority is now given to those applicants that are onshore in Australia and hold a valid working visa to move to Permanent Residency through the Employer Nomination Scheme (includes Regional Sponsored Migration Scheme), this comes as we see a massive change in the way that 457 temporary long stay visas have been reduced either by redundancy or as sponsors find it very difficult to address the new sponsorship criteria set by the Department. 

Case officers ("decision makers") have to "carefully consider the prevailing economic conditions, both globally and locally" and satisfy themselves that "there is a benefit to Australia as opposed to a benefit to the business." Sponsors must be in a possition to demonstrate that they meet at least 1 of the 4 element below;

The four elements of the Benefit to Australia requirement is:

  • The creation or maintenance of employment for Australian citizens or Australian permanent residents;
  • Expansion of Australian trade in goods or services;
  • The improvement of Australian business links with international markets;
  • Competitiveness within sectors of the Australian economy;
