Spouse Visa
To be eligible to apply for a spouse visa you must either be married
to or in a de-facto spouse relationship with your partner at the
time of applying.
Application for a Spouse visa is a 2-stage process. You apply for
both a temporary and a permanent visa in the one application and
at the same time. A temporary visa is granted if you meet all the
initial criteria. This visa remains valid until a decision is made
on your permanent visa application, which is generally two years
after you first applied. If you continue to meet all the requirements,
you will be granted a permanent visa.
Persons applying in Australia for a Spouse visa may not be immediately
eligible to work or study in Australia unless their previous visa
allowed them to do so. Once you have been granted a temporary spouse
visa you will be able to work and study in Australia.
Married Spouse
A married spouse applying for a Spouse visa must be married to their
partner.
Eligibility
You must:
- Be legally married to your sponsor
- Show that you and your sponsor are living together,
or if not, show that the separation is only temporary
- Show that you have a genuine and continuing relationship
with your sponsor
- Show that you and your sponsor have a mutual commitment
to a shared life as husband and wife to the exclusion of all others
- Meet health and character requirements
De Facto spouses (not married)
You and your sponsor must have been in a spouse relationship in
the 12 months immediately prior to lodging your application. If
you have children with your sponsor the 12-month requirement may
be waived.
Eligibility
You must:
- Be of opposite sex to your partner
- Be 18 years or over if you live in Australia or
16 and above if you live in another country
- Show that you and your sponsor have a mutual commitment
to a shared life to the exclusion of all others
- Show that you have a genuine and continuing relationship
with your sponsor
- Show that you and your sponsor have been in a
spouse relationship for the 12 months immediately prior to the
lodgement of the application
- Meet health and character requirements
Sponsorship Requirements
Your sponsor must:
- Be an Australian citizen, Australian permanent
resident or eligible New Zealand citizen
- Be 18 years or over at the time you make your
application or 16 years and over if you and your sponsor both
live in another country
- Be married to you or in a de facto spouse relationship
with you
